MINUTES OF CANTON CITY COMMISSION MEETING
JANUARY 4, 2010

The Canton City Commission met at the Canton Depot, on Monday, January 4, 2010 at 7:00 p.m. with the following members present: Commissioners Alden, Bogue, Bowling, Brown, Glenn, Iverson, Konietzko, Nolte and Mayor Toso. 

The Pledge of Allegiance was recited.

The agenda was approved.

CONSENT CALENDAR
Commissioner Bogue moved and Commissioner Alden seconded to approve the consent calendar consisting of the following: 1) to approve the minutes from the December 21, 2009 City Commission Meeting and that they are signed and published.  2) to approve the warrants to be listed at the end of the minutes.   Unanimous approval.

2010 FUEL BIDS
Commissioner Nolte moved and Commissioner Konietzko seconded to approve the 2010 Fuel Bids to Stern Oil Company at the following rates per gallon $2.7009 for #1 Diesel, $2.4509 for #2 Diesel and $2.6542 for unleaded Gasoline.  Stern Oil Company was the only bidder.   Unanimous approval.

HIAWATHA GOLF COURSE BUILDING SUPPORT
Commissioner Alden moved and Commissioner Brown seconded to table any further discussion on the Golf Course Building until more information can be brought forward.  Unanimous approval.

2010 SALARY RESOLUTION
Commissioner Bowling moved and Commissioner Alden seconded to approve a 1.5% cost of living salary adjustment for all City Employees.  Commissioners Alden, Bogue, Bowling and Konietzko voted aye.  Commissioners Brown, Glenn, Iverson, Nolte and Mayor Toso voted nay.  Motion fails.
Commissioner Glenn moved and Commissioner Nolte seconded to approve a zero cost of living salary adjustment for all City Employees.  Commissioners Glenn, Iverson, and Nolte voted aye.  Commissioners Alden, Bogue, Bowling, Brown, Konietzko and Mayor Toso voted nay.  Motion fails.
Commissioner Brown moved to approve a $.45 per hour cost of living salary adjustment for all City Employees. Motion dies due to a lack of a second.
Commissioner Konietzko moved and Commissioner Bowling seconded to approve a $.25 per hour cost of living salary adjustment for all hourly City Employees and approve the following Resolution and that it be given a number and signed.  Commissioners Alden, Bogue, Bowling, Brown, Konietzko, Nolte and Mayor Toso voted aye.  Commissioners Glenn, and Iverson, voted nay.  Motion carried.

RESOLUTION NO. 1170
2010 WAGE AND SALARY RESOLUTION

WHEREAS, it is in the best interests of the City of Canton to pay a competitive wage to attract and retain the best employees to serve the community.

NOW, THEREFORE, the City Commissioners of the City of Canton hereby approve the following wage and salary rates for the calendar year 2010.

PROVIDED, HOWEVER, the commissioners may make wage increases for the following:  completion of education requirements, passing certification tests, fulfillment of job requirements set at the date of employment, and length of service to the City.  The Commission may also exceed set wage limits if agreed to by the Board of Commissioners.

Commissioner Alden moved and Commissioner Iverson seconded to appoint the following people for the following positions:  Kyle Cwach-Finance Officer, Larry Nelson-City Attorney, Brenda Ask-Assistant City Attorney and Edith Nelson-Head Librarian.  Unanimous Approval.

2010 OFFICIAL DEPOSITORIES
Commissioner Bowling moved and Commissioner Brown seconded to approve the following Banks as official depositories for 2010:  Home Federal Bank, Farmers State Banks, First Bank & Trust, South Dakota Public Funds Investment Trust and First National Bank of Sioux Falls.  Unanimous approval.

2010 OFFICIAL NEWSPAPER
Commissioner Glenn moved and Commissioner Nolte seconded to name the Sioux Valley News as the official newspaper for 2010.  Unanimous approval.

SNOW REMOVAL DISCUSSION
Amy Nelson, City Manager, brought about discussion on the City’s snow removal procedures during the last snow storm.  The Commissioners commended Amy Nelson, Bill Thorson, Public Works Superintendant, and all City Staff for quick and efficient street plowing.  No action taken.

POLICE DEPARTMENT PRESENTATION
Al Warnock, Police Chief, presented a report to the Commission on the Police overtime and a solution to reduce the amount of overtime.  No action taken.

2009 AUDIT ENGAGEMENT LETTER
Commissioner Alden moved and Commissioner Bowling seconded to approve the 2009 Audit Engagement Letter with Gary Larson, CPA as presented and on file and authorize the Mayor to sign.  Unanimous approval.

ENGINEERING AGREEMENT WITH JSA
Commissioner Glenn moved and Commissioner Brown seconded to approve an agreement with JSA Consulting Engineering for engineering work in 2010 as presented and on file and authorize the Mayor to sign.  Unanimous approval.

CONSTRUCTION AGREEMENT FOR LAGOON PROJECT-GRIDOR CONST.
Commissioner Bowling moved and Commissioner Bogue seconded to approve the construction agreement on the sewer lagoons with Gridor Construction as presented and on file and authorize the Mayor to sign.  Unanimous approval.
     
CITY MANAGER APPOINTMENTS
Amy Nelson, City Manager appointed the following people for the following positions:  Al Warnock-Chief of Police, Bill Thorson-Public Works Superintendant, Jeff Fossum-Water and Wastewater Superintendant, Nate Laubach-Fire Chief, Russ Heggen-Rescue Services, Eric Eneboe-Building Inspector and Dr. Dan Heinemann-City Health Inspector.

City Manager Amy Nelson commented on the following:
 Employee appreciation dinner.
 Chamber Banquet is on January 23rd.
City will receive an additional $96,000.00 in grant funds for the Depot project.
There will be three open seats on the Commission this year.
 
Dialogue:
Commissioner Glenn commented on what a great job the City did with snow removal during this last blizzard.

Commissioner Alden moved and Commissioner Iverson seconded to adjourn into executive session for a personnel issue.  Unanimous approval

Mayor Toso called for a recess.
Mayor Toso reconvened the meeting.

Commissioner Brown moved and Commissioner Iverson seconded to reconvene into regular session.

Commissioner Nolte moved and Commissioner Konietzko seconded to adjourn.  Unanimous approval.
